1. Agreement and Scope

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and SnapSell AI ("Company", "we", "us", or "our"), operated by Nova AI Ventures, a company registered in Poland.

By accessing or using our website at snap-sell.app, our mobile application, or any of our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our services.

3.1 Tokens

SnapSell AI uses a token-based system for AI features. Tokens are consumed when you use:

• AI photo enhancement features
• AI video generation
• AI-powered description generation
• Additional AI angle generation from photos

3.2 Token Purchases

Tokens can be purchased through our app. All purchases are:

• Non-refundable once used
• Valid indefinitely (no expiration)
• Non-transferable to other accounts
• Priced in the currency displayed at purchase time

3.3 Refund Policy

Unused tokens may be refunded within 14 days of purchase if you have not used any tokens from that purchase. Partial refunds are not available for partially used token packages. To request a refund, contact support@snap-sell.app.

4. User Content and Listings

4.1 Your Content

You retain ownership of all photos, descriptions, and other content you upload to SnapSell AI. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Process and enhance your photos using our AI technology
• Display your listings on our platform and connected marketplaces
• Create derivative works (enhanced photos, videos) for your listings

4.2 Prohibited Content

You may not list or upload content that:

• Violates any laws or regulations
• Infringes intellectual property rights of others
• Contains illegal, counterfeit, or stolen items
• Includes weapons, drugs, or other restricted items
• Contains inappropriate, offensive, or adult content
• Misrepresents the item being sold

4.3 AI-Enhanced Content

AI-enhanced photos and generated videos are created to represent your items accurately. You are responsible for ensuring that enhanced content does not misrepresent your items. We recommend reviewing all AI-generated content before publishing.

5. External Platform Connections

SnapSell AI allows you to connect external marketplace accounts (eBay, Allegro, etc.). When using these connections:

• You must comply with each platform's terms of service
• We are not responsible for actions taken by external platforms
• Your credentials are securely stored and never shared
• You can disconnect platforms at any time in your settings

Transactions completed on external platforms are subject to those platforms' terms, fees, and buyer protection policies.

6. SnapSell Direct

SnapSell Direct is our built-in marketplace feature where you can sell directly through shareable links.

6.1 Seller Responsibilities

• Accurately describe items and their condition
• Ship items within the stated timeframe
• Respond to buyer inquiries promptly
• Handle returns according to your stated policy

6.2 Payment Processing

Payments for SnapSell Direct sales are processed through Stripe. You must complete Stripe onboarding to receive payments. Payouts are subject to Stripe's terms and processing times.

7. Intellectual Property

7.1 Our Property

All SnapSell AI branding, software, AI models, and platform features are owned by Nova AI Ventures. You may not copy, modify, or create derivative works from our platform.

7.2 Your Property

You retain all rights to your original photos and content. AI-enhanced versions of your content are jointly owned - you may use them freely, and we may use anonymized versions for improving our AI models.

AI-generated content may not always be perfect. We recommend:

• Reviewing all AI-enhanced photos before publishing
• Verifying AI-generated descriptions for accuracy
• Using smart pricing suggestions as guidance, not guarantees

8.3 Limitation of Liability

9. Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse our platform or other users
• Create multiple accounts to circumvent restrictions

Upon termination, unused tokens are forfeited unless termination was due to our error.

10. Data Protection

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Polish data protection laws. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

11. Governing Law and Disputes

These Terms are governed by the laws of Poland. For EU consumers, mandatory consumer protection laws of your country of residence also apply.

Disputes shall be resolved as follows:

2. EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
3. Legal proceedings shall be brought in the courts of Warsaw, Poland

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification at least 30 days before they take effect. Continued use of SnapSell AI after changes constitutes acceptance of the updated Terms.
