Terms of Service

1. Agreement and Scope
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Nova AI Ventures sp. z o.o. ("NovaAI", "we", "us", or "our"), with registered office at ul. Jasna 26, 00-054 Warsaw, Poland (KRS 0001208266, NIP 5253069869), operator of the SnapSell application.
By accessing or using the SnapSell mobile application (iOS and Android), its web version at app.snap-sell.app, or any of our services, you agree to be bound by these Terms. If you disagree with any part of these Terms or our Privacy Policy, you must not use our services.
Age requirement: You must be at least 18 years old with full legal capacity to use SnapSell. By using our services, you confirm that you meet this requirement.
2. Our Services
SnapSell provides a platform that helps you sell items online more effectively. Services include:
AI photo enhancement
Automatic enhancement of your product photos — background removal, lighting optimisation, professional presentation.
AI-powered descriptions and pricing
Generation of optimised product titles, descriptions, and pricing suggestions based on product photos.
Multi-platform listing
Simultaneous publication of your listings on external marketplaces (OLX, Allegro, eBay) via accounts you connect.
Product analyticsconsent required
With your consent, we analyse how features are used to improve the app. Includes session replay with sensitive fields automatically masked. Full details in our Privacy Policy.
Ad measurementconsent required
With your consent (and, on iOS, Apple App Tracking Transparency authorisation), we measure the effectiveness of our advertising campaigns on Meta and Google Ads. Declining this consent does not restrict any app functionality.
Push notifications and in-app advertising
We may display in-app promotional content and, with your system-level permission, send push notifications. Declining notifications does not restrict app functionality.
3. Technical Requirements
To use SnapSell you need:
- A mobile device running one of the two most recent major versions of iOS or Android supported by the operating-system vendor
- A camera to capture product photos
- An active internet connection (not provided by NovaAI)
- Installation of SnapSell only from Apple App Store, Google Play, or other sources designated by NovaAI
- Account registration
If SnapSell stops working on your device due to operating-system changes outside our control, you may request a refund of any purchased and unused Tokens.
4. Token System and Payments
4.1 Tokens
SnapSell uses a token-based system for AI features. Tokens are consumed when you use:
- AI photo enhancement
- AI-powered description generation
- Additional AI-generated product angles from photos
- Listing regeneration with different styles
4.2 Token Purchases
Tokens can be purchased through our app via:
- Apple App Store (iOS in-app purchase)
- Google Play Billing (Android in-app purchase)
- Stripe (web)
All purchases are:
- Non-refundable once the Tokens have been used
- Non-transferable to other accounts
- Priced in the currency displayed at purchase time
4.3 Statutory Right of Withdrawal (14 days)
As a consumer you have a statutory right to withdraw from your token-purchase agreement within 14 days of purchase without stating a reason. If you have used some Tokens before withdrawing, we refund the pro-rata value of unused Tokens. Refunds are issued using the same payment method as the original transaction and within 14 days of receiving your withdrawal notice. To exercise this right, email help@snapsell.app or use the withdrawal-form template appended to our full Polish Regulamin.
5. User Content and Listings
5.1 Your Content
You retain ownership of all photos, descriptions, and other content you upload to SnapSell. By uploading content you grant NovaAI and our AI-model providers a non-exclusive, royalty-free licence to use that content solely for the purpose of providing the Services to you, which includes display, copying, temporary reproduction, transmission, storage, and editing for AI processing.
Not used for AI training: Your photos and listing content are not used to train or improve third-party AI models. AI providers process your data only as instructed, for the duration of each inference call.
5.2 Prohibited Content
You may not upload or list content that:
- Violates laws or third-party rights, including image rights, personal rights, or intellectual-property rights
- Contains pornographic material, especially material involving minors
- Constitutes or encourages criminal activity
- Incites racial, religious, or ethnic hatred
- Promotes violence or aggression
- Is misleading, is a deepfake, or manipulates someone's likeness without their consent
- Misrepresents the item being sold on external marketplaces
5.3 Content Review
NovaAI reserves the right to review user content using automated algorithms under human supervision and to remove content that violates law, good practice, or these Terms. In case of serious or repeated violations your account may be blocked for up to 7 days or terminated; we will notify you by email to the address you provided on registration.
6. Connected Marketplace Accounts
SnapSell allows you to connect external marketplace accounts (OLX, Allegro, eBay). When using these connections:
- You must comply with each platform's own terms of service
- We are not responsible for the actions of external platforms
- We never receive your passwords; authentication happens via OAuth tokens that you can revoke at any time
- You may disconnect platforms at any time in Profile → Connected Platforms
Transactions completed on external marketplaces are subject to those platforms' terms, fees, and buyer-protection policies.
7. AI Models and Quality
AI processing happens automatically, without human review. Content generated by AI models may contain errors, inaccuracies, or material that is incidental to your product. This is the nature of generative AI.
- We do not guarantee the accuracy, completeness, or suitability of AI-generated content
- Always review AI-generated content before publishing it on a marketplace
- If AI output is of unacceptable quality, you can re-run generation at no extra cost or request a refund of the Tokens spent producing it via help@snapsell.app
- We do not use AI to identify you or third parties, verify your identity, or create behavioural profiles
8. Privacy and Consent Controls
On first launch, the app asks for two separate, independent consents:
- Product analytics — enables analysis of how you use the app (Firebase Analytics, Amplitude including Session Replay). Not used for advertising.
- Ad measurement — enables measuring the effectiveness of our ad campaigns on Meta and Google. On iOS, a separate Apple App Tracking Transparency prompt also applies.
Either consent can be withdrawn at any time in Profile → Privacy. Withdrawing a consent does not restrict your access to any app functionality. Full details, including the list of processors and retention periods, are in our Privacy Policy.
9. Intellectual Property and End-User Licence
The SnapSell app, branding, logos, software, and AI integrations are owned by NovaAI or its licensors. Installing the app and accepting these Terms grants you a non-exclusive, non-transferable licence to use SnapSell for private purposes within the functionality we make available.
Without our prior written consent you may not:
- Translate, adapt, rearrange, or otherwise modify the app (except within the scope permitted by mandatory Polish copyright law)
- Reverse-engineer, decompile, or study the app beyond what mandatory law permits
- Distribute or make the app available to third parties
Material produced via AI within the app is for your private use, including publishing on external marketplaces. Other use and redistribution is prohibited without our prior written consent.
10. Disclaimers and Limitation of Liability
10.1 Service Availability
SNAPSELL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT AI FEATURES WILL MEET YOUR SPECIFIC EXPECTATIONS.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW — AND WITHOUT RESTRICTING YOUR MANDATORY CONSUMER RIGHTS UNDER POLISH AND EU LAW — NOVAAI SHALL NOT BE LIABLE FOR: (A) INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; (B) LOSS OF PROFITS OR SALES FROM YOUR LISTINGS; (C) ACTIONS OF BUYERS OR EXTERNAL MARKETPLACES; (D) ANY AMOUNT EXCEEDING THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Nothing in these Terms limits liability that cannot be excluded under applicable consumer-protection law.
11. Complaints
You may submit a complaint about the app or any Service at any time. We prefer complaints by email to help@snapsell.app. It helps us respond faster if you include:
- Your name
- A brief description of the circumstances
- The date on which the issue arose
- What remedy you are seeking
We will review your complaint and respond within 14 days of receiving it.
12. Account Termination
You may delete your account at any time in Profile → Delete Account. NovaAI may suspend or terminate your account if you:
- Violate these Terms, in particular §5.2
- Engage in fraudulent or illegal activity
- Abuse our platform, our AI models, or other users
- Create multiple accounts to circumvent restrictions
In case of immediate termination for material breach that occurs during an active plan or before your Tokens have been used, we will refund pro-rata the amount paid in advance for the period during which access was lost and for unused Tokens.
13. Data Protection
Personal data is processed in accordance with GDPR and Polish data-protection law. Our Privacy Policy contains the full list of processors — including Amplitude (product analytics, session replay), Meta Platforms Ireland (ad measurement on mobile), Google Ireland (Google Ads and Firebase), Cloudflare (storage), Sentry (crash monitoring), Stripe (web payments), Apple and Google (in-app purchases), and our AI providers — along with retention periods and your rights under GDPR.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. If a change has a more-than-minor negative impact on your access to the Services, you may terminate the agreement without cost within 30 days of the change entering into force and receive a refund for any unused subscription period or unused Tokens. Continued use of SnapSell after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by Polish law. For EU consumers, mandatory consumer-protection laws of your country of residence continue to apply.
Disputes are resolved as follows:
- Contact help@snapsell.app to attempt resolution
- EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
- Polish consumers may seek free assistance from the Municipal Consumer Ombudsman or the Polish Office of Competition and Consumer Protection at uokik.gov.pl
- Legal proceedings may be brought before the court competent for your place of residence or other court competent under applicable law
